General Terms and Conditions

1 General and Scope

These general terms and conditions (the "GTC") apply between Nitya Botanicals, Inzlingerstrasse 89, 4125 Riehen ("Nitya Botanicals") and you as a user ("Customer") of the webshop www.nityabotanicals.com ("Webshop"). By accessing the Webshop, you agree to be bound by these Terms and Conditions[BM1] . If you do not agree with the GTC, Nitya Botanicals will ask you to leave the Webshop. Nitya Botanicals is entitled to amend, modify or delete the GTC at any time without notice. The current and binding version of the GTC will be published at www.nityabotanicals.com. The current version of the GTC at the time of an order is always applicable.

The webshop enables the customer to buy various articles of the in the field of natural cosmetics. The use of the webshop is free of charge. However, there is a charge for ordering items from the webshop. The entire content of the webshop is protected by copyright. However, this offer is always subject to the condition that the contract is dissolved if delivery is not possible or the price is incorrect. The purchase contract for products or services in the web store is concluded between the customer and Nitya Botanicals as soon as the customer places an order in the web store ("purchase contract").

Nitya Botanicals delivers only within Switzerland. Delivery is at the expense and risk of the customer, even if partial deliveries are made. No liability is assumed for delays in delivery. If the delivery to the customer cannot take place for reasons for which the customer is responsible (e.g. incorrect or incomplete addressing, refusal of acceptance without justified reason, etc.), the resulting costs (e.g. new delivery, return, etc.) will be charged to the customer.

7. Transfer of benefit and risk

Benefit and risk of the object of purchase shall pass to the customer as soon as the consignment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible through no fault of Nitya Botanicals, the risk shall pass to the customer upon notification of readiness for shipment.

8 Warranty

Nitya Botanicals must be notified in writing of any complaints due to incomplete or incorrect delivery without delay, at the latest 20 calendar days after the invoice date. All warranties for the products offered in the online store on the part of Nitya Botanicals towards the customer are excluded. A purchased product cannot be taken back. In all other respects, the exclusions of liability pursuant to clause 9 shall apply. Further claims are excluded.

The scope of liability of Nitya Botanicals for the web store and the goods offered therein complies with the mandatory legal provisions. 11. Final provisions

The invalidity of one or more provisions of these GTC shall not affect the validity of the remaining provisions of the GTC. Void provisions shall be replaced by a new provision that comes as close as possible to the economic and legal success of the void provision.
General terms and conditions of the customer shall not apply.Swiss law is exclusively applicable to these GTC and this contract. The place of jurisdiction for any disputes is Basel.
